Welcome to From The Art. By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully.

1. About From The Art

From The Art ("we," "our," or "the platform") is an online marketplace that connects artists with buyers. We are a for-profit company that facilitates transactions between independent artists and art buyers.

Important: From The Art is not a charity, nonprofit organization, or tax-exempt entity. We do not direct charitable donations—artists choose which nonprofit organizations to support through their sales.

2. User Accounts

2.1 Account Creation

To access certain features, you must create an account. You agree to provide accurate information and keep your account credentials secure.

2.2 Account Types

  • Buyers: Can browse and purchase artworks
  • Artists: Can list and sell artworks after verification

2.3 Artist Verification

Artists must complete a verification process before selling. We reserve the right to approve or deny applications at our discretion.

3. Artist Terms

3.1 Subscription Plans

Artists may choose from the following subscription plans:

  • Starter ($29/month): 0% commission, up to 5 artworks
  • Pro ($59/month): 0% commission, unlimited artworks, advanced features
  • Community ($129/month): Coming soon

3.2 Artist Responsibilities

Artists agree to:

  • Only list original works or works they have legal rights to sell
  • Provide accurate descriptions and images
  • Ship artworks promptly after purchase
  • Handle returns according to their stated policy
  • Comply with all applicable laws

3.3 Payouts

Artist earnings are paid via Stripe Connect. Artists are responsible for their own tax obligations.

4. Buyer Terms

4.1 Purchases

When you purchase artwork, you enter into a transaction with the artist. From The Art facilitates this transaction but is not a party to the sale.

4.2 Shipping

Artists ship directly to buyers. Estimated delivery times and shipping costs are displayed at checkout.

4.3 Returns

Return policies are set by individual artists. Check the artwork listing for the applicable return policy.

5. Donations

5.1 How Donations Work

Artists may designate a percentage of their sale price to be donated to a nonprofit organization of their choice. Buyers may optionally add an additional donation at checkout.

5.2 Donation Hold Period

Donations are held for 14 days after delivery confirmation before being transferred to the nonprofit organization. This allows time for any issues to be resolved.

5.3 Tax Receipts

From The Art does not issue tax receipts for donations. Tax receipt eligibility depends on the nonprofit organization and applicable laws in your jurisdiction. If you require a tax receipt, please contact the nonprofit organization directly.

5.4 Nonprofit Partnerships

We facilitate donations to nonprofit organizations but do not endorse, control, or guarantee the activities of any nonprofit. From The Art is not responsible for how nonprofits use donated funds.

6. Intellectual Property

Artists retain all intellectual property rights to their work. By listing artwork, artists grant From The Art a license to display and promote their work on our platform.

7. Prohibited Conduct

You agree not to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • List counterfeit, stolen, or unauthorized works
  • Engage in fraudulent transactions
  • Harass or harm other users
  • Attempt to circumvent platform fees
  • Use automated systems to access our platform

8. Limitation of Liability

To the maximum extent permitted by law, From The Art shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

We do not guarantee the quality, safety, or legality of items listed. Transactions are between buyers and artists.

9. Dispute Resolution

We encourage users to resolve disputes directly. If needed, contact us at support@fromtheart.com for assistance. We may mediate but are not obligated to resolve disputes.

10. Changes to Terms

We may update these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms.

11. Governing Law

These terms are governed by the laws of the Province of New Brunswick, Canada.
